Terms and Conditions

1. Acceptance of Terms

By accessing, browsing, or using the DesireWork website, web application, assessment tools, digital content, or any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must immediately discontinue use of the Services.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and DesireWork, LLC ("DesireWork," "we," "us," or "our"). DesireWork reserves the right to modify these Terms at any time. Continued use of the Services following any modifications constitutes acceptance of the revised Terms.

2. Intellectual Property Ownership

All content, materials, methodologies, frameworks, assessments, diagnostic tools, inventories, question structures, scoring systems, written works, graphics, logos, trademarks, trade dress, and other intellectual property associated with DesireWork (collectively, "DesireWork IP") are the exclusive property of DesireWork, LLC and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

DesireWork IP includes, without limitation:

  • The DesireWork assessment and diagnostic framework;
  • All proprietary sentence structures, diagnostic formulations, and assessment language (including the "You settle for / You secretly long for" construct);
  • The Root-Out Activity (ROA) inventory and all associated questions, prompts, tags, and scoring rubrics;
  • Any Enneagram-based assessment tools, typologies, or interpretive frameworks developed by DesireWork;
  • All website content, digital course materials, certification program curricula, and retreat content; and
  • All trade names, service marks, logos, and brand elements.

Nothing in these Terms grants the User any right, title, or interest in any DesireWork IP beyond the limited license expressly stated in Section 3.

3. Limited License to Use

Subject to your compliance with these Terms, DesireWork grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your personal, non-commercial purposes.

This license does not permit you to:

  • Reproduce, duplicate, copy, sell, trade, resell, or exploit any portion of the Services or DesireWork IP;
  • Modify, adapt, translate, reverse-engineer, decompile, or create derivative works based on any DesireWork IP;
  • Distribute, publicly display, publicly perform, or transmit any DesireWork IP to any third party;
  • Use any DesireWork IP to develop, offer, or market any competing product, framework, assessment, certification, coaching tool, or service;
  • Scrape, crawl, data-mine, or use automated tools to extract content or data from the Services;
  • Frame, mirror, or otherwise incorporate the Services or any portion thereof into any other website, application, or platform; or
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.

4. Prohibition on Copying and Reproduction

The unauthorized copying, reproduction, redistribution, or commercial exploitation of DesireWork IP is strictly prohibited. This prohibition extends to all formats and media, whether digital, print, audio, video, or any format now known or hereafter developed.

Without limiting the foregoing, you may not:

  • Screenshot, photograph, record, transcribe, or otherwise capture assessment questions, diagnostic outputs, scoring logic, or inventory content for the purpose of reproduction or redistribution;
  • Share your login credentials, assessment results, or licensed content with any third party;
  • Repost, republish, or redistribute any DesireWork content on social media, blogs, newsletters, podcasts, or any other public or semi-public platform without prior written consent;
  • Paraphrase, restate, or otherwise repackage DesireWork's proprietary frameworks, constructs, or methodologies in a manner that appropriates the substance of DesireWork IP; or
  • Use DesireWork IP as training data, input, or reference material for any artificial intelligence, machine learning, or automated content-generation system.

Any use of DesireWork IP not expressly authorized under these Terms requires advance written permission from DesireWork, LLC. Requests may be submitted to support@desirework.com.

5. User Accounts and Access

Certain features of the Services may require registration and creation of a user account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

DesireWork reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that DesireWork determines, in its sole discretion, violates these Terms or is harmful to other users, DesireWork, or third parties.

6. Assessment and Framework Disclaimers

The DesireWork assessment, diagnostic tools, and related content are intended for personal development and self-reflection purposes only. They do not constitute and should not be construed as psychological, psychiatric, medical, therapeutic, legal, financial, or professional advice of any kind.

DesireWork makes no representations or warranties regarding the accuracy, completeness, reliability, or applicability of assessment results or framework insights. Results are provided "as is" and are not a substitute for professional consultation. You acknowledge and agree that your reliance on any assessment output or framework content is entirely at your own risk.

7. User-Generated Content

To the extent the Services permit you to submit, post, or otherwise provide content (including assessment responses, reflections, and feedback), you retain ownership of the original content you create. However, by submitting content through the Services, you grant DesireWork a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such content in connection with the operation, promotion, and improvement of the Services.

You represent and warrant that any content you submit does not infringe the intellectual property or other rights of any third party and does not contain unlawful, defamatory, or otherwise objectionable material.

8. Privacy and Data Use

Your use of the Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Services, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy. DesireWork will handle all personal data in accordance with applicable data protection laws.

9. Subscriptions, Billing, and Refunds

Access to the inventories, cycles, dashboard, and reports requires a paid subscription to The DesireWork Collection (the "Subscription"). The Subscription is billed annually in advance at the price displayed at the time of purchase. Payment is processed by Stripe, Inc.; DesireWork does not receive or store your full payment card details. Your use of Stripe's checkout is also subject to Stripe's own terms.

14-day free trial. New subscriptions begin with a fourteen (14) day free trial. A valid payment method is collected when you start the trial but is not charged during it. If you cancel at any point before the trial ends, you are charged nothing. Unless cancelled, the Subscription converts automatically to a paid annual term at the end of the trial, and your payment method is charged the then-current price. The trial is offered once per customer.

Automatic renewal. The Subscription renews automatically at the end of each annual term, at the then-current price, unless cancelled before the renewal date. You authorize DesireWork to charge your saved payment method for each renewal. We will make reasonable efforts to notify you in advance of any price change, and any such change will take effect only at your next renewal.

Refunds. Because the free trial lets you evaluate the Services at no cost and cancel before any charge, amounts already charged are non-refundable except where a refund is required by applicable law. This does not limit any statutory rights you may have. If you believe a charge is mistaken, email support@desirework.com from the email address associated with your account and we will review it. Any refund issued is returned to the original payment method and typically appears within five to ten business days, depending on your bank or card issuer.

Cancellation. You may cancel at any time from your account's billing settings. Cancellation stops future renewals; unless you also request a refund under the guarantee above, you retain access for the remainder of the term you have already paid for. Cancelling does not, by itself, generate a refund.

Failed payments. If a renewal payment fails, DesireWork may retry the charge and may suspend access to paid features until payment succeeds. Accounts that remain unpaid may be downgraded. Your submitted assessment data is retained in accordance with the Privacy Policy and is not deleted merely because a Subscription lapses.

Free features. DesireWork may offer certain features at no charge, including the introductory mini assessment. Free features are provided as-is and may be modified, limited, or discontinued at any time.

Taxes. Prices are stated in U.S. dollars and exclude any applicable sales, use, VAT, GST, or similar taxes, which may be added at checkout where required.

10. DMCA and Copyright Infringement

DesireWork respects the intellectual property rights of others and expects Users to do the same. If you believe that any content on the Services infringes your copyright, please submit a notice in accordance with the Digital Millennium Copyright Act (DMCA) to our designated agent at support@desirework.com. DesireWork will respond to valid DMCA notices and may remove or disable access to allegedly infringing material.

DesireWork actively monitors for unauthorized use and reproduction of its proprietary content and reserves the right to pursue all available legal remedies against infringers.

11. Enforcement and Remedies

You acknowledge and agree that any unauthorized use of DesireWork IP may cause irreparable harm to DesireWork for which monetary damages would be an inadequate remedy. Accordingly, DesireWork shall be entitled to seek injunctive or other equitable relief in addition to any other remedies available at law or in equity, without the requirement of posting a bond or other security.

In any action to enforce these Terms, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs from the non-prevailing party.

12. Third-Party Links and Services

The Services may contain links to or integrations with third-party websites, services, or content. DesireWork does not endorse, control, or assume responsibility for any third-party content or services. Your interactions with third parties are solely between you and those third parties.

13. Limitation of Liability

To the maximum extent permitted by applicable law, DesireWork and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of or inability to use the Services.

In no event shall DesireWork's total aggregate liability for all claims arising out of or relating to these Terms or the Services exceed the greater of (a) the amount you paid to DesireWork in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

14. Indemnification

You agree to indemnify, defend, and hold harmless DesireWork and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in the State of Minnesota, and you consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceedings, the parties agree to attempt in good faith to resolve any dispute through informal negotiation for a period of at least thirty (30) days following written notice of the dispute.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

17. Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements you enter into with DesireWork in connection with specific Services (such as certification program agreements or retreat participation waivers), constitute the entire agreement between you and DesireWork regarding your use of the Services and supersede all prior and contemporaneous agreements, representations, and understandings.
